Right to Work Checks Are Changing – Stay Updated!

As you will know, during the COVID-19 pandemic there have been a lot of changes to the way that we conduct recruitment. This update will focus on the right to work checks, which have been completed online recently – but this is changing from June 21st, 2021.

This update replaces any previous guidance, and from June 21st employers need to resume face to face, physical document checking when employing. Currently, checks can be done over video calls, and applicants can use scanned documents rather than originals. Once these adjustments end, you must check original, physical documents in the presence of the holder, whether in person or via video call. Alternatively, you can check online if you have the candidates’ right to work share code, and their permission to view this.

You do not need to complete retrospective checks for employees who went through the adjusted process, between March 30th, 2020, and June 20th, 2021 (inclusive).

If any employee or applicant cannot show their documents, you need to contact the Home Office Employer Checking Service. Businesses who employ individuals who do not have the right to work in the UK can face penalties.
